These Terms of Service (“Terms”) govern your access to and use of the Hitchikr mobile application and website (the “Service”), operated by Hitchikr, [registered entity name] (“Hitchikr”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. What Hitchikr is
Hitchikr is a technology platform that connects riders seeking transport with independent drivers willing to provide it. Hitchikr does not itself provide transport services; drivers are independent providers and not employees of Hitchikr.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for the accuracy of the information on your account and for keeping your login details secure. You are responsible for all activity under your account.
3. Rider responsibilities
- Provide accurate pickup and destination information.
- Treat drivers and their vehicles with respect.
- Pay the fare shown for each trip using an accepted payment method.
- Comply with all applicable laws during a trip.
4. Driver responsibilities
- Hold and maintain a valid driver's licence, PrDP, roadworthy vehicle, insurance and all documents required by law.
- Provide accurate registration information and pass our vetting before accepting rides.
- Drive safely, lawfully and professionally, and keep the vehicle in a roadworthy condition.
- Comply with all tax and regulatory obligations arising from your earnings.
5. Fares, payments and payouts
Fares are calculated using factors such as distance and time and are shown before you confirm a ride. Payments are processed by our third-party payment provider. Hitchikr may charge drivers a service commission on each completed fare, disclosed in the driver app. Driver payouts are made to the bank account provided, subject to verification.
6. Cancellations
Riders and drivers may cancel a ride in line with the cancellation rules shown in the app. A cancellation fee may apply where a party cancels after a driver has been dispatched or after a defined waiting period.
7. Conduct and safety
You agree not to use the Service for any unlawful, fraudulent or harmful purpose, not to harass or endanger others, and not to interfere with the operation of the Service. We may suspend or terminate accounts that breach these Terms or that pose a safety or fraud risk.
Hitchikr offers safety features such as trip sharing, pickup PIN verification, automated trip check-ins (RideCheck) and an in-app SOS. These are provided to assist you but are not a substitute for the emergency services. In a genuine emergency, always contact the police (10111) or the relevant emergency services directly. We cannot guarantee that any safety feature, alert or notification will be delivered, received or acted on in time.
8. Ratings and reports
Trips may be rated by both parties, and users may report safety or fraud concerns. We may review trip data and in-app messages to investigate reports and enforce these Terms.
9. Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, Hitchikr does not warrant that the Service will be uninterrupted or error-free, and is not responsible for the acts or omissions of independent drivers or riders.
10. Limitation of liability
To the maximum extent permitted by law, Hitchikr shall not be liable for indirect, incidental or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be excluded under South African law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect users or the Service.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa, and you submit to the jurisdiction of its courts.
13. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
